1. Introduction

Welcome to FastTrack Logistics. These Terms of Service ("Terms") govern your use of our services, website, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

FastTrack Logistics ("we," "us," or "our") is a logistics company registered in Romania, providing freight transportation, warehousing, distribution, and supply chain management solutions.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you must not use our Services.

2. Services

FastTrack Logistics provides logistics services including but not limited to:

• Freight transportation (road, rail, air, and sea)
• Warehousing and distribution
• Supply chain analytics
• Customs clearance
• Temperature-controlled transportation

The specific services provided will be outlined in the service agreement between FastTrack Logistics and the client. All services are subject to availability and we reserve the right to refuse service to anyone for any reason at any time.

3. Service Agreements

All services provided by FastTrack Logistics are governed by a written service agreement. The service agreement will specify:

• The scope of services to be provided
• Service level agreements and performance metrics
• Pricing and payment terms
• Duration of service
• Termination conditions

In case of any discrepancy between these Terms and the service agreement, the terms of the service agreement shall prevail.

4. Client Obligations

As a client of FastTrack Logistics, you agree to:

• Provide accurate and complete information about the goods to be transported or stored
• Ensure that goods are properly packaged and labeled according to applicable regulations
• Comply with all applicable laws and regulations related to the transportation and storage of your goods
• Pay all fees and charges as outlined in the service agreement
• Notify us promptly of any special handling requirements or dangerous goods
• Provide necessary documentation for customs clearance when required

Failure to meet these obligations may result in service delays, additional charges, or termination of services.

5. Liability and Insurance

FastTrack Logistics' liability for loss, damage, or delay of goods is limited as follows:

• For road transportation within Romania and the EU: in accordance with the Convention on the Contract for the International Carriage of Goods by Road (CMR)
• For air transportation: in accordance with the Warsaw Convention or the Montreal Convention, as applicable
• For sea transportation: in accordance with the Hague-Visby Rules or applicable maritime regulations
• For warehousing: as specified in the service agreement

We recommend that clients obtain appropriate insurance coverage for their goods. FastTrack Logistics can arrange cargo insurance upon request at an additional cost.

FastTrack Logistics shall not be liable for:

• Indirect or consequential losses arising from the loss, damage, or delay of goods
• Loss or damage resulting from inadequate packaging or incorrect information provided by the client
• Loss or damage caused by circumstances beyond our reasonable control (force majeure)

6. Force Majeure

FastTrack Logistics shall not be liable for failure to perform any obligation under these Terms if such failure is caused by circumstances beyond our reasonable control, including but not limited to:

• Natural disasters or extreme weather conditions
• War, terrorism, riots, or civil unrest
• Government actions or restrictions
• Labor disputes or strikes
• Cyber attacks or telecommunications failures
• Pandemics or public health emergencies

In such cases, we will notify you as soon as possible and work to mitigate the impact on our services.

7. Confidentiality

FastTrack Logistics respects the confidentiality of client information. We will:

• Use client information only for the purpose of providing our services
• Protect confidential information with appropriate security measures
• Not disclose confidential information to third parties without consent, except as required by law or for service provision

8. Intellectual Property

All intellectual property rights in our website, software, applications, and materials are owned by or licensed to FastTrack Logistics. These include but are not limited to:

• Trademarks, service marks, and logos
• Website content and design
• Software and applications
• Business methodologies and processes

You may not use, reproduce, or distribute our intellectual property without our prior written consent.

9. Termination

Either party may terminate the service agreement according to the terms specified therein. Upon termination:

• All outstanding fees become immediately due and payable
• FastTrack Logistics will complete any shipments already in transit
• Clients must arrange for the removal of their goods from our warehouses within the timeframe specified in the service agreement

FastTrack Logistics reserves the right to terminate services immediately in case of:

• Non-payment of fees
• Provision of false or misleading information
• Violation of applicable laws or regulations
• Breach of these Terms or the service agreement

10. Dispute Resolution

Any disputes arising from or relating to these Terms or our services shall be resolved as follows:

• The parties will first attempt to resolve the dispute through good-faith negotiation
• If negotiation fails, the dispute will be submitted to mediation under the rules of the Romanian Mediation Center
• If mediation fails, the dispute will be resolved exclusively by the courts of Bucharest, Romania

These Terms are governed by the laws of Romania, without regard to its conflict of law principles.

11. Amendments

FastTrack Logistics reserves the right to modify these Terms at any time. We will notify clients of significant changes through:

• Email notification
• Posting notice on our website
• Notification in client portals or applications

Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
